Terms of Service

From everyone at IQTHINK LLC, thank you for using our products. We build Can Do, Birthday Hello, Ello, and other services (collectively referred to as "Services"). When we say "Company", "we", "us", or "our", we mean IQTHINK LLC, an Illinois limited liability company. When we say "you" or "your", we mean you — the person or entity using our Services.

When you use our Services, now or in the future, you are agreeing to these Terms. We may update these Terms in the future. When we make significant changes, we will notify active users. Continued use of our Services after changes constitutes acceptance of the updated Terms.

Account Terms

You are responsible for maintaining the security of your account and password. The Company cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. You are responsible for all content posted to and activity that occurs under your account, even when content is posted by others who have access to your account.

You must be a human. Accounts registered by bots or automated methods are not permitted. You must be at least 16 years of age to use our Services.

Payment, Refunds & Plan Changes

For paid Services, billing occurs on a recurring basis — monthly or annually, depending on the plan you choose. All fees are non-refundable by default. That said, we want you to be happy. If you contact us within 30 days of a payment, we'll work with you to make it right. For annual plans, we offer prorated refunds if you cancel before the year is up.

We may change our pricing from time to time. When we do, we will give at least 30 days' notice. Pricing changes will take effect at the start of your next billing cycle.

If we offer a free trial, you will not be charged until the trial period ends. You may cancel at any time during the trial without being charged.

Cancellation & Termination

You are free to cancel your account at any time. You can do so directly within the Service or by contacting us at [email protected]. Upon cancellation, your content will become inaccessible immediately. We will permanently delete your content within 30 days from our active systems and within 60 days from our backups, unless legally required to retain it.

We reserve the right to suspend or terminate your account for any reason at any time. We will make reasonable efforts to contact you before taking action, except in cases of clear abuse — including spam, illegal activity, or actions that place an unreasonable burden on our infrastructure.

Modifications to the Service

We reserve the right to modify or discontinue any part of our Services at any time. We are always improving and adding features, but sometimes we remove things too. If we discontinue a Service entirely, we will give at least 30 days' notice and help you export your data where possible.

Uptime, Security & Privacy

Our Services are provided "as is" and "as available." We do not offer formal SLAs for any of our Services, but we take uptime seriously — we want our products available to you whenever you need them.

We take security seriously and implement reasonable measures to protect your data. We use secure OAuth authentication where applicable and do not store credentials we don't need.

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

Content Ownership

You own your content. We do not claim any intellectual property rights over the material you provide to our Services. All content you post, upload, or store remains yours. We will not access, use, or share your content except as necessary to provide the Services, comply with the law, or protect our rights.

The look and feel of our Services — including software, design, text, graphics, and logos — are owned by or licensed to IQTHINK LLC and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of our Services without prior written consent.

Liability

You use our Services at your sole risk. To the maximum extent permitted by law, IQTHINK LLC is not liable to you or any third party for damages of any kind — including indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, use, or goodwill — resulting from your use of or inability to use the Services.

Governing Law

These Terms are governed by the laws of the State of Illinois, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Services shall be resolved in the courts located in the State of Illinois.

These Terms constitute the entire agreement between you and IQTHINK LLC regarding the use of our Services. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
